After a 10 month civil court matter, using contact centres, my local court and county court baliffs to retrieve monies owed to me by the debtor, I found myself with no support and limited options, feeling like the debtor was getting off scott-free I contact West Country Baliffs after nearly losing all hope that I would ever have my money retrieved from the Debtor. We own a holiday let in Devon and have had no issues over 9 years until just recently where we had a booking from a major platform. These guests broke house rules with smoking in the property, noise and antisocial behaviour which resulted in one resident in the building having to leave and stay elsewhere. We were so stressed, distraught and sick with worry and the fear of loss of control over what was happening. We contacted West Country Bailiffs and Jon was so reassuring, informative and efficient. He told us exactly what we had to do which was firstly to terminate their booking contract as they had failed to adhere to our house rules which they signed up to at the time of booking. Forfeiture of a Commercial Lease – FAQs

1. What is forfeiture of a commercial lease?

Forfeiture is the legal process a landlord can use to terminate a commercial lease when a tenant breaches the lease terms—most commonly for non-payment of rent or serious breaches such as misuse of the premises. It brings the lease to an end and removes the tenant’s right to occupy the property.


2. Can a landlord forfeit a lease without going to court?

Yes, in cases of rent arrears, landlords can usually forfeit the lease through peaceable re-entry, provided the lease includes a forfeiture clause. For other breaches, a Section 146 Notice must first be served, and court action may be necessary if the breach is not remedied.


3. What is a Section 146 Notice?

A Section 146 Notice is a legal notice that must be served on the tenant before forfeiting a lease for breaches other than rent arrears. It outlines the breach and gives the tenant a reasonable opportunity to remedy it, where applicable.


4. What happens after a commercial lease is forfeited?
