We instructed West Country Bailiffs to apply to the courts to gain a Warrant of possession and arrange for Bailiffs to attend the eviction of a non paying tenant, they provided us with a great service, Jon, was always at hand to provide an update and always answered emails and calls with a professional and courteous manner. West Country Bailiffs took all of the stress out of what has been a stressful situation. We will use their services again if the need arises and would recommend their services to anyone.Posted on Google![]()

I discussed a matter with Jon as I was unsure of my available next steps. A tenant had left a property with damage and owing rent. I had some details and after discussion, Jon advised me to pursue a different route of recovery. This was a professional and knowledgeable service to go forward with a hopeful resolution. Great servicePosted on Google![]()

After a 10 month civil court matter, using contact centres, my local court and county court baliffs to retrieve monies owed to me by the debtor, I found myself with no support and limited options, feeling like the debtor was getting off scott-free I contact West Country Baliffs after nearly losing all hope that I would ever have my money retrieved from the Debtor. The service i received is phenomenal! Within two months, the matter had been resolved, monies retrieved and a suitable payment plan was put in place for the remainder. My only wish is that I had used West Country Baliffs from the start of the process, which would have made my life so much easier! 10/10 would recommend. It also makes me feel secure that if I have to go through anything like this again, I can rely on this company to enforce.Posted on Google![]()

We own a holiday let in Devon and have had no issues over 9 years until just recently where we had a booking from a major platform. These guests broke house rules with smoking in the property, noise and antisocial behaviour which resulted in one resident in the building having to leave and stay elsewhere. We were so stressed, distraught and sick with worry and the fear of loss of control over what was happening. We contacted West Country Bailiffs and Jon was so reassuring, informative and efficient. He told us exactly what we had to do which was firstly to terminate their booking contract as they had failed to adhere to our house rules which they signed up to at the time of booking. Jon and his team carried out the eviction of these 'guests' peacefully the next morning within 3 hours. They were so professional, efficient, sensitive and caring to everyone involved. We honestly can't praise them highly enough! We were kept informed and updated throughout and had a video and full report as well as safe delivery of keys to a designated person. They organised everything down to the last detail. We are beyond impressed with their outstanding service and so grateful and relieved at the outcome. Had we not contacted them as soon as we did, things could have gone so very differently. Thank you so much West Country Bailiffs! We 100% recommend your services to others who may well find themselves in a similar situation.Posted on Google![]()

I had some reservations about using an enforcement agency because of the delicate matter I was having to deal with. I had several discussions with Jon before making an informed decision to employ their services. Their communication was excellent and extremely supportive to all parties involved in this matter. I was extremely happy with the service provided by Jon and his experienced bailiff Kai alongwith Jordan. Kai was extremely compassionate when dealing with the sensitive situation of regaining possession of a property and his reassuring manner was very much appreciated. The communication was first class and he kept in touch throughout the whole process. I am very glad I have used this company and its staff. I would recommend them to anyone needing a professional law enforcement company.Posted on Google![]()

I recently used Jon and the team at West Country Bailiffs to help recover a long‑overdue County Court Judgment debt, and I’m really glad I did. After almost a year of getting nowhere with the debtor, broken promises, delays, and excuses, Jon talked me through the High Court enforcement process step by step. He was straightforward, clear about what to expect, and always honest about the options. What I appreciated most was how easy they were to deal with. They kept me updated without me having to chase, explained things in plain English, and moved quickly whenever something needed to be done. It’s clear they really know what they’re doing when it comes to enforcement. Thanks to Jon and his team, the debt is now finally being recovered, something I had pretty much written off at one point. If you’re a business or an individual trying to enforce a CCJ or recover unpaid debts, I’d definitely recommend West Country Bailiffs. They’re professional, efficient, and keep you in the loop from start to finish. Thanks again, Jon, your help has made a big difference.Verified by TrustindexTrustindex verified badge is the Universal Symbol of Trust. An excluded occupier is someone occupying your property without the protections that tenants are afforded under the Eviction Act 1977. This category includes:
Lodgers who share kitchen or bathroom facilities with their landlord
Occupants living rent-free (contributions toward bills are not considered rent)
Short-term holiday occupants staying in temporary or holiday-let accommodation
Individuals in emergency accommodation arranged by the local council
Temporarily housed residents living in council, housing association, or charity-run hostels
Asylum seekers accommodated by the Home Office while awaiting a decision
Individuals served with a ‘no right to rent’ notice from the Home Office
Unlike tenants, excluded occupiers don’t have the same legal protections, allowing for faster removal, but you still need to follow proper legal protocols.

An excluded occupier is someone who lives in accommodation but does not have the same legal rights as a tenant under housing law. This typically includes lodgers who share living spaces (such as a kitchen or bathroom) with their landlord, or individuals occupying accommodation provided on a temporary or informal basis.
Excluded occupiers do not benefit from full protection under the Protection from Eviction Act 1977, meaning the eviction process is simpler and faster than for most tenancies.
In most cases, no court order is required. If the local council or housing authority has ended their duty to house the occupier and has issued notice, the landlord can lawfully proceed with eviction without going through the courts.
This is because excluded occupiers are not protected under the Protection from Eviction Act 1977, and landlords are therefore not legally required to obtain a possession order before reclaiming their property.
Yes. If a local authority accepts a main housing duty and allows the occupier to remain in temporary accommodation on an indefinite basis, that person gains basic protection under the Protection from Eviction Act 1977.
In these situations, the occupier can only be removed through the proper court process by obtaining a possession order.
Although a formal notice period isn’t always required by law, landlords are expected to give reasonable notice — often equivalent to the rental payment period (e.g., one week or one month).
This notice should clearly state the date by which the occupier must vacate the property.
At West Country Bailiffs, we can prepare and serve a legally compliant Notice to Quit on your behalf to ensure the process is handled correctly and respectfully.
No. Reasonable force cannot be used. However, once the notice period has expired, our certificated enforcement agentscan attend to lawfully remove the occupier.
We can also arrange an accredited locksmith to secure the premises, and where goods or belongings are left behind, we’ll serve a Torts Notice and provide supervised access for the lawful removal of personal items.
The process can be completed relatively quickly compared to standard evictions.
Once the notice has expired, eviction can usually be carried out within a few days, depending on scheduling and any additional security or locksmith arrangements required.
Excluded occupiers have limited rights to challenge an eviction, as they are not covered by the same tenancy laws. However, landlords must still follow the correct process and act reasonably to avoid allegations of harassment or illegal eviction.
Our specialist team of solicitors, paralegals, and enforcement agents handle the entire excluded occupier eviction process — from assessing your legal position to serving notices, attending with locksmiths, and securing vacant possession of your property.
We ensure every step is lawful, efficient, and professional, giving you peace of mind throughout the process.
